Terms of service

These Terms of Service (hereinafter the "Terms") set out the conditions for using our shop (which includes this website; hereinafter no particular distinction is made between the two). These Terms apply to all customers who use our shop.
Agreement to These Terms
By using our shop, the customer is deemed to have given valid and irrevocable consent to these Terms. Customers who do not agree to these Terms may not use our shop.

 

Registration

A person wishing to use our shop may register to use it by agreeing to these Terms, applying for registration by the method prescribed by our shop, and having our shop approve the application.

Refusal of Registration

Our shop may decline to approve an application for registration if it determines that any of the following circumstances apply. Our shop bears no obligation whatsoever to disclose the reason for refusing registration.

  • Where false information has been submitted
  • Where the application is from a person who has previously violated these Terms
  • Where our shop otherwise determines that registration is not appropriate

Use by Minors

If the customer is a minor, please use our shop only after obtaining the consent of a legal guardian. If a customer who began using our shop without the consent of a legal guardian reaches the age of majority, they shall be deemed to have ratified their acts of use during the period of minority.

Management of Login Information

The customer shall appropriately manage their login information for our shop at their own responsibility. Under no circumstances may the customer transfer, lend, or share their login information with any third party. Our shop bears no responsibility whatsoever for any damage arising from the use of login information by a third party, except where our shop has acted with intent or gross negligence.

Orders

When a customer places an order for a product, the order constitutes an offer to enter into a contract to purchase the product from our shop. Our shop's acceptance of the customer's offer is established when an email or other communication notifying the customer that the product has been shipped is sent to the customer.

Cancellation of Orders

Cancellations of orders due to customer circumstances are not accepted.

Termination Due to Violation of These Terms

Our shop may terminate the purchase contract with a customer without prior notice if the customer falls under any of the following circumstances. In such cases, our shop bears no obligation to compensate the customer for damages.

  • Where the customer has violated, or is likely to violate, these Terms
  • Where the customer has previously violated these Terms, or is a related party of such a person
  • Where our shop otherwise determines that the relationship of trust between our shop and the customer has been damaged

Refusal of Receipt, Etc.

If the customer does not accept receipt of the product, if the delivery address is unknown, or if delivery to the designated address is otherwise impossible due to the customer's circumstances, our shop will incur losses including round-trip shipping costs, cash-on-delivery handling fees, return processing fees, product storage fees, redelivery costs, the cost of certified mail and other communications with the customer, packaging material costs, and personnel costs for shipping and return processing. Our shop may charge these costs to the customer. If the following period elapses from the date receipt did not take place, the purchase contract between our shop and the customer shall be deemed terminated due to the customer's circumstances. In this case, our shop is released from its obligation to deliver the product, and the customer shall immediately pay our shop, as a penalty, an amount equivalent to the price of the product in question in addition to the amount of the losses above.

Returns and Exchanges

Returns and exchanges are not accepted. However, where a product is found to be clearly defective, we will accept a return or exchange only if, within 7 days counting from the day after the date of receipt, an email stating the specific reason for the defect is sent to the email address designated by our shop and reaches our shop. No returns or exchanges will be accepted thereafter, for any reason.

Other Rules Concerning the Sale of Products

In addition to the matters set out above under "Orders," "Cancellation of Orders," "Termination Due to Violation of These Terms," "Refusal of Receipt, Etc.," and "Returns and Exchanges," the payment method for the price of products sold by our shop, the timing of the transfer of ownership, the delivery method, the method of cancelling a purchase offer, and the method of returning products shall be governed by the disclosure based on the Act on Specified Commercial Transactions and by other methods separately prescribed by our shop.

Late Payment Damages

A customer who has delayed payment of a monetary obligation to our shop shall pay our shop late payment damages at the rate of 14.6% per annum.

Prohibited Conduct

In using our shop, the customer must not engage in any of the following conduct.

  • Conduct that violates, or promotes the violation of, laws and regulations, court judgments, decisions or orders, or legally binding administrative measures
  • Conduct that infringes the intellectual property rights of our shop or third parties
  • Conduct that infringes the portrait rights, privacy, honour, or other rights or interests of our shop or third parties
  • Conduct that places an excessive burden on the servers or networks of our shop or third parties, or interferes with their normal operation
  • Conduct that may interfere with the operation of our shop's services
  • Gaining or attempting to gain unauthorised access
  • Analysing the source code of this service through disassembly, decompilation, reverse engineering, or the like
  • Gaining unauthorised access to systems connected to our shop, or unlawfully altering or deleting information stored on our shop's equipment
  • Reproducing, transmitting, transferring, lending, or modifying our shop's website or software
  • Lending, transferring, or trading accounts or content on our shop to third parties for a fee
  • Commercially exploiting information obtained through our shop
  • Conduct intended to obtain profit in connection with our shop through methods not intended by our shop
  • Advertising, promotion, solicitation, or business activity on our shop that is not permitted by our shop
  • Collecting or accumulating personal information about other customers
  • Using our shop for illegal, improper, or unjust purposes
  • Conduct that causes disadvantage, damage, or discomfort to other customers of our shop or other third parties
  • Impersonating other customers
  • Using another customer's account
  • Conduct for the purpose of meeting a member of the opposite sex with whom one is not acquainted
  • Directly or indirectly providing benefits to anti-social forces
  • Conduct that violates public order and morals
  • Using our shop while walking, driving a vehicle, or in other circumstances or manners in which use of our shop is inappropriate
  • Other conduct that our shop deems inappropriate
  • Conduct related to criminal acts

Exclusion of Anti-Social Forces

The customer represents and warrants that they do not fall under, and will not in the future fall under, any of the following items.

  • That they themselves (in the case of a corporation or other organisation, including their officers) are a member of an organised crime group, a member who ceased to be such less than five years ago, a quasi-member of an organised crime group, a company affiliated with an organised crime group, a corporate racketeer, a group engaging in criminal activities under the guise of conducting social campaigns, a special intelligence violent group, or any other person equivalent to these (hereinafter collectively "Members of Organised Crime Groups, Etc.")
  • Where the customer is a corporation or other organisation, having a relationship in which Members of Organised Crime Groups, Etc. are recognised as controlling its management
  • Where the customer is a corporation or other organisation, having a relationship in which Members of Organised Crime Groups, Etc. are recognised as substantially involved in its management
  • Having a relationship in which Members of Organised Crime Groups, Etc. are recognised as being used, such as by conducting transactions for the purpose of unjust gain for oneself or a third party, or for the purpose of causing damage to a third party
  • Having a relationship in which one is recognised as being involved in providing funds or other benefits to, or extending convenience to, Members of Organised Crime Groups, Etc.
  • Where the customer is a corporation or other organisation, having officers or persons substantially involved in its management who have a socially reprehensible relationship with Members of Organised Crime Groups, Etc.

The customer warrants that they will not, by themselves or through a third party, engage in any of the following conduct.

  • Violent demands
  • Unjust demands exceeding legal responsibility
  • Threatening behaviour or use of violence in connection with transactions
  • Conduct that damages our shop's credit or interferes with our shop's business by spreading rumours, using deceptive means, or using force
  • Other conduct equivalent to the foregoing

Restriction of Use

Our shop may, without prior notice, restrict the customer's use of all or part of our shop, or cancel the customer's registration, if the customer falls under any of the following. Our shop bears no responsibility whatsoever for any damage caused to the customer by actions taken by our shop under this article.

  • Where the customer has violated any provision of these Terms
  • Where it is found that there are false facts in the registration details
  • Where there has been a default on a monetary obligation
  • Where there is no response to communication from our shop after a reasonable period has elapsed
  • Where there has been no use of our shop for a reasonable period since the last date of use
  • Where our shop determines that the customer is an anti-social force or the like, or is engaged in any interaction or involvement with anti-social forces
  • Where our shop otherwise determines that use is not appropriate

Suspension of Service Provision

Our shop may suspend or interrupt the provision of all or part of the service without prior notice to the customer if it determines that any of the following circumstances apply. Our shop bears no responsibility whatsoever for any disadvantage or damage suffered by the customer or a third party in such cases.

  • Where maintenance, inspection, or updating of the computer systems relating to our shop is carried out
  • Where provision of our shop becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, natural disaster, or the spread of a virus
  • Where computers or communication lines stop due to an accident
  • Where our shop otherwise determines that provision of our shop is difficult

Withdrawal

The customer may cancel their registration and withdraw from our shop by the procedure prescribed by our shop.

Disclaimer of Warranties

Our shop does not warrant that the content it provides on the website is free from system bugs or infringement of third-party rights. Nor does it warrant the safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose.

Limitation of Liability

Our shop bears no responsibility whatsoever for any damage arising to the customer in connection with the use of our shop. However, this disclaimer does not apply where the contract between our shop and the customer concerning our shop (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act. Even where it constitutes a consumer contract, our shop shall be liable to compensate only for damage that arises directly and actually to the customer due to our shop's negligence (excluding gross negligence), and the amount of such compensation shall be limited to the purchase price of the product directly related to the damage.

Changes to Service Content

Our shop may change the content of our shop, or suspend or terminate the provision of our shop, without notice to the customer. Our shop bears no responsibility whatsoever for any damage arising to the customer as a result.

Changes to the Terms of Service

Our shop may change these Terms at any time without notice to the customer. The revised Terms shall take effect from the time they are posted on our shop's website. A customer who continues to use our shop after the revision of these Terms shall be deemed to have agreed to the revised Terms.

Handling of Personal Information

Personal information of the customer obtained through the use of our shop shall be handled appropriately in accordance with our shop's privacy policy.

Notices and Communications

Notices or communications between the customer and our shop shall be made by the method prescribed by our shop. Unless the customer submits a change notification in accordance with the method separately prescribed by our shop, our shop shall regard the currently registered contact details as valid and send notices or communications to those details, which shall be deemed to have reached the customer at the time of dispatch.

Assignment of Rights and Obligations

The customer may not assign to a third party, or offer as security, their status under the use contract or their rights or obligations under these Terms, without the prior written consent of our shop.

Business Transfer

If our shop transfers the business relating to our shop to another company (including business transfer, company split, and any other case in which the business is transferred), our shop may transfer to the transferee of that business transfer the status under the use contract, the rights and obligations under these Terms, and the customer's information. The customer is deemed to have consented in advance to such transfer.

Application

These Terms apply to all relationships between the customer and our shop relating to the use of our shop. In addition to these Terms, our shop may establish rules for use. These rules, regardless of their name, form part of these Terms. Where these Terms conflict with these rules, the rules shall take precedence.

Severability

Even if any provision of these Terms, or part thereof, is found to be invalid or unenforceable, that finding shall not affect the remaining parts, and the remaining parts of these Terms shall continue to be valid and enforceable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.

Jurisdiction

In the event of a dispute concerning the use of our shop, the following district court shall be the exclusive court of jurisdiction by agreement for the first instance:
